Terms of Service

Segmiq provides software to capture, manage, score, and convert leads (Segmiq CRM) and to document and showcase projects (Segmiq Cloud). Features may change as we improve the product. The two products share an account but may be offered on separate plans.

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your accounts and for your users. You must be able to form a binding contract to use the service.

Paid plans are billed in advance on a recurring basis (monthly unless stated otherwise) per the pricing presented at sign-up. Fees are non-refundable except where required by law or expressly stated. We may change pricing with reasonable notice. Set out your currency, taxes, late-payment, and cancellation terms here.

You agree not to misuse the service, including by breaking the law, infringing others’ rights, sending unlawful or unsolicited messages, attempting to breach security, or interfering with the platform. Messaging through WhatsApp and other channels must comply with those providers’ policies.

You retain ownership of the data you put into the service. You grant us the rights needed to host and process it to provide the service. You are responsible for having a lawful basis to collect and contact the prospects whose data you upload, including any consent required for messaging, and for the content you publish on public profiles.

Segmiq and its software, design, and brand are owned by us. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription. You may not copy, resell, or reverse-engineer the platform except as allowed by law.

The service relies on third parties such as Meta WhatsApp, Twilio, and others. Their availability and terms are outside our control, and your use of those integrations is also subject to their terms.

Each party may receive non-public information from the other. The receiving party will protect it and use it only to perform under these Terms.

The service is provided “as is” to the extent permitted by law. We do not warrant that it will be uninterrupted or error-free, or that it will achieve any particular sales outcome. Any performance figures shown are illustrative.

To the maximum extent permitted by law, neither party is liable for indirect or consequential losses, and our total liability is limited as set out here (commonly capped at the fees paid in the preceding period). Set your specific cap and exclusions with your advisor.

These Terms apply while you use the service. You may stop using it at any time. We may suspend or terminate access for breach of these Terms or non-payment. On termination, you can export your data for a defined window, after which it may be deleted.

We may update these Terms. We will update the “last updated” date and, for material changes, give reasonable notice. Continued use after changes means you accept them.

State the governing law and the courts or dispute-resolution venue that apply (for example, the jurisdiction where Segmiq is registered). Confirm this with your legal advisor for the markets you operate in.
